Virtual Office Website (VOW) Terms of Use

These Virtual Office Website Terms of Use (“VOW Terms”) govern your access to and use of the restricted property-listing data (“VOW Data”) displayed on the Virtual Office Website portion of https://buyrealty.ca (the “VOW”), operated by 1773966 ONTARIO INC. o/a BUYREALTY.CA, an Ontario real-estate brokerage registered with the Real Estate Council of Ontario (RECO Registration #5017217). These VOW Terms supplement and are incorporated into the Terms of Use and the Privacy Policy. By electing to view VOW Data, you agree to be bound by these VOW Terms in addition to those documents.

These VOW Terms are required by, and are intended to comply with, the Toronto Regional Real Estate Board (TRREB) F168 Authorized Agreement, the PROPTX Information Security Policy 2024, and applicable Member Board rules governing Virtual Office Websites.

1. What Is “VOW Data”?

“VOW Data” means the subset of MLS® listing-related data that is licensed to BuyRealty.ca for display only to registered users who have completed VOW consent. VOW Data includes, without limitation:

• Sold and closed prices for transactions reported to TRREB / PROPTX;
• Days-on-market history for prior listing instances of a property;
• Listing-history timeline — the chronological record of price changes, status changes, and re-listings of a property;
• Broker remarks and confidential remarks where furnished by the listing brokerage;
• Other data fields designated by TRREB, PROPTX, or any other originating Member Board as “VOW data”, “consumer-protected data”, or restricted-access data.

“IDX Data” (governed by the public-display rules of the Internet Data Exchange Agreement) consists of currently-active listing fields available without VOW consent — including current list price, basic property characteristics, and the primary listing photograph — and is shown to all visitors of the Site without registration.

2. Registration & Consent

Access to VOW Data is restricted to registered users who have:

• Created an account on this Site (including providing a verifiable email address and phone number, and successfully completing email + SMS verification where required);
• Read and acknowledged these VOW Terms of Use, the Terms of Use, and the Privacy Policy;
• Affirmatively elected to receive VOW Data by clicking “I agree” on the VOW consent modal that is presented on the first attempted access to a VOW-restricted field. The version of the consent text presented at that moment is recorded against your account in the wp_crea_vow_consent audit table.

VOW consent is account-bound and version-aware. If we update these VOW Terms in a material way, we will revoke standing consent for the prior version and require you to re-acknowledge the new version on your next access to VOW Data.

3. Audit Logging (F168 §5 / PROPTX 2024 §6)

By accessing VOW Data, you acknowledge and consent to the following audit-logging practices, which are required by §5 of the F168 Authorized Agreement and §6 of the PROPTX Information Security Policy 2024:

• Each individual access to a VOW-restricted field is logged with the timestamp, your IP address, the listing identifier (MLS® number / ListingKey), the field accessed, and your User identifier;
• Audit records are retained for the period mandated by TRREB / PROPTX and may be disclosed to TRREB, PROPTX, the originating Member Board, the originating listing brokerage, or law-enforcement authorities upon lawful request;
• Aggregate access patterns may be analysed for security purposes (detection of scraping, credential sharing, or unauthorized redistribution).

4. Permitted Use of VOW Data

VOW Data is provided to you solely for your personal, non-commercial use in connection with the identification of properties of interest to you and the obtaining of real estate services from a licensed real estate professional. You agree:

• Not to redistribute VOW Data — including by email, SMS, social media, screen capture, file sharing, web posting, automated extraction, or any other means — to any person who has not themselves completed registration and VOW consent on this Site;
• Not to share your account credentials with any other person. VOW access is bound to a single registered user; credential sharing is grounds for immediate account termination;
• Not to scrape, harvest, or automate access to VOW Data using any robot, spider, script, or any other automated means;
• Not to use VOW Data to compete with the originating Member Board(s), the originating listing brokerage(s), BuyRealty.ca, or any licensed real estate professional;
• Not to use VOW Data in a manner that violates applicable law, including the Personal Information Protection and Electronic Documents Act (PIPEDA), the Trust in Real Estate Services Act, 2002 (TRESA), or the RECO Code of Ethics.

5. Withdrawal of VOW Consent

You may withdraw your VOW consent at any time by emailing [email protected] with the subject line “Revoke VOW Consent” from the email address registered to your account. Upon withdrawal:

• VOW Data fields will no longer be displayed to your account on subsequent visits;
• The standing-consent record in wp_crea_vow_consent is preserved (it is an audit row, not editable), and a new drx_vow_consent_revoked_at marker is added to your account;
• Audit-log entries for any VOW Data you accessed prior to withdrawal are preserved for the period mandated by TRREB / PROPTX;
• You may re-enable VOW access at any time by re-completing the VOW consent flow.

6. Termination & Suspension

BuyRealty.ca may suspend or terminate your VOW access at any time, with or without notice, for any reason, including without limitation: violation of these VOW Terms, violation of the Terms of Use, suspected redistribution or scraping of VOW Data, suspected credential sharing, request from TRREB / PROPTX / the originating Member Board, or for any other reason at our sole discretion. Termination of VOW access does not entitle you to any refund and does not affect the audit records previously created against your account.

7. Disclaimer of Accuracy (Reaffirmed)

VOW Data, like all listing data displayed on this Site, is deemed reliable but is not guaranteed to be accurate. Sold prices, days-on-market figures, listing-history timelines, and broker remarks are reported by the originating listing brokerage(s) to TRREB / PROPTX and may contain errors, omissions, late corrections, or status reversals. You should independently verify any VOW Data with your retained real-estate professional or qualified third-party experts before relying on it for any purpose.
