These Terms of Use (“Terms”) govern your access to and use of the website at https://buyrealty.ca (the “Site”), operated by 1773966 ONTARIO INC. o/a BUYREALTY.CA, an Ontario real-estate brokerage registered with the Real Estate Council of Ontario (RECO Registration #5017217), with its registered office at 401 Magnetic Drive, Unit 12, Toronto, ON M3J 3H9 (“BuyRealty.ca”, “we”, “us”, “our”). By accessing or using the Site, you (“you”, “User”) agree to be bound by these Terms, our Privacy Policy, and our IDX Disclaimer. If you do not agree to all of these terms, you must not access or use the Site.

1. Eligibility & Account Registration

You must be at least 18 years of age and capable of entering into a legally binding contract under the laws of Ontario to use this Site. Some features (saved favourites, saved searches, tour-booking requests, document signing, and Virtual Office Website (VOW) data) require account registration. You agree to provide accurate, current, and complete information during registration and to keep your credentials secure. You are solely responsible for all activity occurring under your account.

2. Permitted Use of MLS® Data

The property-listing data displayed on this Site is sourced from the Toronto Regional Real Estate Board (TRREB) via the PROPTX Data Distribution Facility, and from the Canadian Real Estate Association (CREA) via the Data Distribution Facility (DDF®). All such data is the copyrighted property of the originating Member Board(s) and is licensed to BuyRealty.ca under the following frameworks:

You may use the listing data displayed on this Site solely for your personal, non-commercial use to identify properties of interest to you, to contact a real estate professional regarding such properties, and to obtain information about real estate services. You may not:

3. Virtual Office Website (VOW) Provisions

Certain restricted listing data — including sold/closed prices, days-on-market history, listing-history timeline, broker remarks where furnished, and other data fields designated by TRREB as “VOW data” — is available only to registered users who have completed the VOW consent acknowledgment (“VOW Users”). Access to VOW data is governed by the separate VOW Terms of Use, which are incorporated into these Terms by reference. By electing to view VOW data, you confirm that you have read, understood, and agreed to those terms.

Each access to VOW-restricted fields is logged with a timestamp, your IP address, the listing key, and your User identifier, as required by §5 of the F168 Authorized Agreement and the PROPTX Information Security Policy 2024. These audit records are retained for the period mandated by the originating Member Board.

4. Brokerage Services & Communications

BuyRealty.ca is an Ontario real estate brokerage subject to the Trust in Real Estate Services Act, 2002 (TRESA) and the RECO Code of Ethics. When you submit a tour request, contact a salesperson, or otherwise initiate a brokerage relationship through this Site, the obligations and disclosures required under TRESA, the RECO Code of Ethics, and the Information Guide (RECO Information Guide) apply.

By providing your phone number or email address, you consent to receive transactional communications (including tour confirmations, document-signing notifications, and account messages) by SMS, email, MMS, WhatsApp, or RCS, and you consent to commercial electronic messages (CEMs) within the meaning of Canada’s Anti-Spam Legislation (CASL) related to your active inquiries and account activity. You may withdraw consent at any time by following the unsubscribe instructions in any message or by contacting us at [email protected]. We honour the National Do Not Call List (DNCR) and Canada’s Anti-Spam Legislation; outbound calls and texts are scrubbed against the DNCR before dispatch.

5. Intellectual Property

The Site, including its design, layout, source code, copy, photography (other than MLS® listing photographs, which remain the copyrighted property of the originating listing brokerage), graphics, logos, and trademarks, is the property of BuyRealty.ca or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual-property laws. The marks MLS®, Multiple Listing Service®, REALTOR®, and the associated logos are owned by The Canadian Real Estate Association (CREA) and identify the quality of services provided by real estate professionals who are members of CREA. The mark TRREB® and the associated logos are owned by the Toronto Regional Real Estate Board.

6. Disclaimers & Accuracy

All listing data displayed on this Site is provided “AS IS” and is deemed reliable but is not guaranteed to be accurate by TRREB, PROPTX, CREA, the originating Member Boards, or BuyRealty.ca. Property information — including but not limited to dimensions, square footage, lot size, taxes, zoning, room counts, school catchments, and listing status — should be independently verified by you, your retained real-estate professional, or qualified third-party experts before you make any purchase, sale, or financial decision. Listing data is updated multiple times per day from the originating feeds; however, there may be a delay between the time a status changes (e.g., from Active to Sold) and the time the change is reflected on this Site.

To the maximum extent permitted by applicable law, BuyRealty.ca, its directors, officers, employees, agents, and licensors disclaim all warranties, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement, or accuracy of data.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall BuyRealty.ca or its directors, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost data, or lost opportunities, arising out of or in connection with your access to or use of the Site, even if advised of the possibility of such damages. Our aggregate liability arising out of or relating to these Terms or your use of the Site shall not exceed CAD $100.

8. Termination

We may suspend or terminate your account or access to the Site at any time, with or without notice, for any reason, including without limitation any violation of these Terms, the IDX Disclaimer, the VOW Terms of Use, the F168 Authorized Agreement, the PROPTX Information Security Policy 2024, or any applicable law or regulation. You may terminate your account at any time by contacting [email protected]. Provisions of these Terms that by their nature should survive termination — including without limitation Sections 2, 5, 6, 7, 9, 10, 11, and 12 — shall survive any termination.

9. Privacy

Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes our compliance with PIPEDA, CASL, TRESA, the RECO Code of Ethics, FINTRAC PCMLTFA, the F168 Authorized Agreement, and the PROPTX Information Security Policy 2024.

10. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The courts of Ontario shall have exclusive jurisdiction to hear any dispute arising out of or relating to these Terms or the Site.

11. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top of this page reflects the date of the most recent revision. Material changes will be notified to registered users by email or through a prominent notice on the Site. Your continued use of the Site after the effective date of any revision constitutes your acceptance of the revised Terms.
